The Builders Hub is a multi-tenant platform designed for home builders to manage their listings, communities, floorplans, and customer interactions. The Service includes:

• Property and community listing management
• Build On Your Lot (BOYL) features
• AI-powered sales assistant
• CRM integrations
• Analytics and reporting
• Lead capture and management

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

The Service offers various subscription tiers (Starter, Growth, Enterprise) with different features and pricing. By subscribing to a paid plan, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information
• Accept automatic renewal unless you cancel before the renewal date
• Understand that fees are generally non-refundable

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload false, misleading, or fraudulent property listings
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Harvest or collect user data without consent
• Use the Service for spam or unsolicited communications

6. Content and Data

Your Content: You retain ownership of content you upload to the Service (property listings, images, descriptions). By uploading content, you grant us a license to use, display, and distribute that content in connection with the Service.

Accuracy: You are responsible for ensuring that all property information, pricing, and availability data you provide is accurate and up-to-date.

Data Protection: We handle your data in accordance with our Privacy Policy. You are responsible for complying with applicable data protection laws when collecting and processing customer data through the Service.

7. AI Features

The Service includes AI-powered features such as the AI Sales Assistant. You acknowledge that:

• AI responses are generated automatically and may not always be accurate
• You are responsible for reviewing and configuring AI behavior
• AI usage is subject to fair use limits based on your subscription tier
• You must disclose to users when they are interacting with AI

8. Third-Party Integrations

The Service may integrate with third-party services (HubSpot, Lasso CRM, Zillow, etc.). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for third-party services or their availability.

9. Intellectual Property

The Service, including its design, features, and technology, is owned by The Builders Hub and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BUILDERS HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your data after a reasonable retention period
• You remain liable for any outstanding fees

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
